AMK Agent Banking Terms and Conditions
1. Scope
These terms and conditions govern the provision of Agent banking products or services offered by AMK (“Agent Banking Services”) through the Agent to AMK’s customers, detailing the rights, obligations, and responsibilities of both parties. It shall form an agreement between you and AMK and set out the Terms and Conditions governing your access to and usage of AMK Agent Banking Application.
This is an important document that you shall read and understand carefully before deciding to use AMK Agent Banking Application and Services. Please contact AMK if you do not understand, or you are unsure about any aspect of these Terms and Conditions.
Agent Banking Services refers to products or services offered by AMK through the Agent to AMK’s customers in Cambodia.
2. Definition
The following definitions apply to these Terms and Conditions:
“AMK”, “We”, “Our” and “Us” means AMK Microfinance Institution PLC.
“Agent”, “You”, “Your”, “Agent user” refers to the appointed individual or entity authorized by AMK under the Agent Agreement to provide banking services and products to its customers and/or business partners.
“Agent Banking Application”, “Agent Application”, “AMK Agent”, “Application” means a mobile application developed by AMK with features or functions for the Agent to perform transactions at their outlet or shop for the customers.
“Customer” refers to AMK’s customers including individuals or entities.
“Bakong” is the latest generation of Mobile Payments and Banking Platform initiated by the National Bank of Cambodia for a peer-to-peer fund transfer service available to retail customers of local banks, financial institutions, and payment service providers in Cambodia.
“PIN” means the six-digit confidential code that is secret to you and used to authorize a transaction and login to the application.
“Website” means www.amkmfi.com.kh or www.amkcambodia.com.
3. Registration and Eligibilities
To register for the use of Agent Banking Services, Agents shall install Agent Banking Application, which Agents can download it from App Store (IOS) or Play Store (Android) or other available methods through technology, into Agent’s devices. Agents are required to contact AMK Contact Center details in section 20 of this Terms and Conditions to authorize a new login device.
Agents must adhere to AMK’s eligibility criteria and complete the registration process to offer AMK’s Agent Banking Services. AMK reserves the right to reject any Agent application without the obligation to provide reasons for rejection.
4. Service Description
Agent Banking Services provided through Agent Banking Application include money transfer, bill payment, phone top-up, cash deposit/ cash-in, cash withdrawal/ cash-out, loan repayment with AMK’s customers, partner’s customers, and Bakong member’s customers, receiving funds from international remittance, other payment services, and other additional products and services introduced by AMK from time to time.
5. Fees and Charges
AMK will charge a transaction fee from you or customer based on AMK’s products and services or its platform to process customers’ transactions.
The fees and charges shall be adhered to AMK’s established fee structure, accessible at Agent outlets, shops, or publicly on AMK’s website. AMK reserves the right to adjust the fees and charges periodically to maintain competitiveness in the market and ensure business sustainability.
6. Daily and Transaction Limit Amount
AMK may impose daily and transaction limit amounts on various services, subject to the change at AMK’s discretion at any time. Agents and Customers will be duly informed of any modifications.
7. Accessibilities, Availabilities, and Connectivity
Availability and access to Agent Banking Services are contingent on technological, network, and system factors. AMK will make reasonable efforts to ensure uninterrupted service but does not guarantee continuous access. AMK shall not be liable to you or customers for any incompleteness, unavailability, failure, interruption, suspension, or delay in AMK Agent Banking Application/Services including but not limited to the sending of any alert or notification, receipt or execution of any instructions from AMK as it is beyond AMK control including internet connection failure.
8. Application Version Control
Agents must use the latest version of AMK’s Agent Banking application to ensure compatibility and access to all available features. Additionally, Agents shall receive an alert of the notification when there is a new version of the Application.
You agree to indemnify AMK against any losses or damages which you may suffer due to any claims, demands or actions of any kinds brought against you arising directly or indirectly resulting from not using the latest version of the Application.
9. General Risk Protection and Prevention
In addition to AMK’s security measures, Agents are instructed to implement preventive measures to mitigate risks effectively. Some of the instructions provided to agents include:
- Regular Software Updates: Agents should keep their devices and software up-to-date to patch known vulnerabilities.
- Secure Network Connections: Agents should avoid using public or unsecured Wi-Fi networks when accessing the AMK Agent Banking application.
- Transaction Verification: Agents should verify all transactions thoroughly before processing to detect and prevent fraudulent activities.
By adhering to these preventive measures, agents can significantly reduce the risks associated with fraud and unauthorized access, thereby enhancing the overall security of AMK’s Agent Banking Services.
10. User Acknowledgement
Agents acknowledge and accept the risks associated with the service conducted via electronic banking on this Agent Banking Application, including but not limited to system outages, delays, and unauthorized access.
11. Notification and Alert
Agents agree to receive notifications and alerts related to their account activity, transactions, and Agent Banking Services via registered contact details.
12. Default Debit Account
Agents must designate a default debit account for transactions and fees associated with Agent Banking Services.
13. Restricted Acts
Agents shall refrain from engaging in prohibited activities, including but not limited to fraudulent transactions, money laundering and the terrorist financing.
14. Anti-Money Laundering/Combating of Financing of Terrorism/Sanctions
Agents must comply with AMK’s Anti-Money Laundering (AML), Combating of Financing of Terrorism (CFT), and sanctions policies. AMK may conduct due diligence as deemed necessary.
15. User Obligation
AMK provides comprehensive guidelines to ensure PIN security and integrity within the Agent Banking application. Agents shall comply with the followings:
- PIN Confidentiality: Agents are instructed to keep their PINs confidential and avoid sharing them with anyone, including colleagues or family members. This ensures that only the authorized Agent has access to their account within the Agent Banking Application.
- PIN Change Procedures: Agents shall comply with AMK’s instructions on how Agents can change their PINs periodically to further enhance security. This may involve accessing specific settings within the Application or contacting AMK’s support team for assistance.
- Lockout Policies: Agents shall acknowledge that AMK may implement lockout policies that temporarily disable access to the Agent Banking Application after a certain number of failed PIN attempts. This helps prevent unauthorized access by malicious actors attempting to guess the PIN.
- Restricting Biometric Identifiers: Agent shall not allow others to set their biometric identifiers (Fingerprint or/and Face ID) on devices used to access your Application.
- Precautions During Use: Agent shall not leave their mobile phone or device unattended while logged into your Application. Agent shall ensure that the PIN remain confidential and take necessary precautions to prevent them from being disclosed to others and shield your PIN from being observed by others while entering it to access your Application.
- Caution Against Unauthorized Calls: Disregard all calls or requests, even if they claim to be from AMK, requesting your PIN. Agent acknowledges that AMK or its staff will never request this information over the phone. If such incident happens, Agent shall report such incidents to AMK immediately.
By incorporating these provisions and instructions, AMK aims to promote strong PIN security practices among Agents and minimize the risk of unauthorized access or fraudulent activities within the Agent Banking Application.
16. Privacy and Confidentiality
AMK is collecting your personal information, instructions and transaction details on your Account (collectively referred to as “Information”) to enable AMK to provide Agent Banking Services to you. Without this information, AMK may not be able to provide you such services.
By subscribing and utilizing Agent Banking Application, you agree that AMK may use and disclose your information to:
- Any person engaged by AMK to carry out or assist its functions and activities;
- Any subsidiary, affiliate or associate entity of AMK, and any of the AMK’s head office; branches, sub-branches, agents, correspondents, agencies or representative offices;
- AMK’s auditors and professional advisors including its lawyers;
- AMK’s stationery printers the vendors of the computer systems used by AMK and to such person(s) installing and maintaining the same and other suppliers of goods or service providers engaged by AMK;
- Any person to whom disclosure is permitted or required by any statutory provision by laws;
- Any credit bureau of which AMK or AMK’s head office or any sister branch is a member, any other member(s) and/or compliance committee of such credit bureau; and/or
- Any governmental agencies and authorities in the Kingdom of Cambodia and/or elsewhere.
17. User Deactivate/Block
AMK reserves the right to deactivate or block an Agent’s access to Agent Banking Services at its discretion, with or without notice.
18. Liability
AMK bears no responsibility for any loss, damage, or inconvenience resulting from the use of Agent Banking Services, unless attributable to gross negligence or willful misconduct.
You are accountable for all transactions carried out when utilizing AMK’s products and services, except in cases involving fraud or negligence by AMK, its employees, Agents, or any partners cooperating with AMK.
19. Indemnity
To the extent permitted by Law, you agree to indemnify AMK against any losses or damages which AMK may suffer due to any claims, demands or actions of any kinds brought against AMK arising directly or indirectly because you:
- have not followed your obligations under the Terms and Conditions; or
- acted negligently or fraudulently in connection with the Terms and Conditions.
20. Discrepancies/Errors, Questions, and Complaints
Agents must immediately report any discrepancies, errors, or raise questions and complaints regarding Agent Banking services to AMK and must comply with instruction given by AMK. The Agent may reach out to contact center numbers: 087 220 202 or 071 822 0202.
21. Notices and Changes
AMK will communicate important notices and changes to Agents via registered contact details, official channels, or electronic notices generated within AMK’s system.
22. Changes in Details
Agents must promptly notify AMK of any changes in their contact details or other relevant information.
23. Declaration
Agents declare that the information provided during registration is true and accurate, and they agree to abide by these Terms and Conditions.
24. Disruption to Service
AMK is not liable for disruptions to Agent Banking Services due to force majeure, natural disasters, or other unforeseen circumstances.
25. Governing law
These Terms and Conditions are governed by the laws of Kingdom of Cambodia.
26. Dispute resolution
Any dispute or claim arising out of or relating to the Terms and Conditions or use of Agent Banking Services and your relationship with AMK will be resolved by AMK’s Contact Center in compliance with the Customer Suggestion and Complaint Policy before referring to the exclusive jurisdiction of Cambodian court.
27. Disclaimer
AMK provides Agent Banking Services without any express or implied representations, warranties, or conditions. We do not guarantee continuous accessibility or acceptance of your AMK Agent Banking Application.
AMK disclaims liability for incidental, indirect, or consequential damages, including loss of profit, revenue, or use. We are not responsible for unauthorized access, alteration, theft, or destruction of the AMK Agent Banking Application due to accident, misuse, fraudulent means, or delays arising from circumstances beyond our control.
